These Terms & Conditions (the “Terms”) govern your use of load-bear.co.uk (the “Site”) and the sale of any goods you purchase from us. Please read them carefully. By using the Site or placing an order you agree to be bound by these Terms.
1. Definitions
- “We”, “us”, “our” means Wheeler Fabrications Ltd, trading as LoadBear.
- “You”, “your” means the customer placing an order or using the Site.
- “Goods” means the products listed for sale on the Site, including made-to-order items.
- “Order” means your offer to purchase Goods from us under these Terms.
- “Contract” means the binding agreement between you and us, formed when we accept your Order (see clause 3).
2. Use of the Site
You agree to use the Site lawfully and not to: (a) attempt to gain unauthorised access to any part of the Site or its underlying systems; (b) introduce viruses or other harmful material; (c) use the Site to send unsolicited communications; or (d) reproduce, copy or resell any part of the Site without our written consent.
We reserve the right to suspend or terminate access to the Site for any user who breaches these Terms.
3. Orders and contract formation
When you submit an Order through checkout, you are making an offer to buy the Goods. Your Order is accepted, and a Contract is formed, only when we send you an order confirmation email. Until that point we may decline your Order for any reason, including stock availability, pricing errors, or suspected fraud.
If we cannot accept your Order we will notify you and refund any payment taken in full.
4. Pricing and payment
- All prices on the Site are shown in pounds sterling (GBP, £) and are exclusive of VAT unless stated otherwise. VAT is added at the prevailing UK rate at checkout where applicable.
- Delivery is charged separately at the rates shown at checkout. See our Delivery Information page.
- Payment is taken in full at the point of order via Stripe. We accept the major debit and credit cards displayed at checkout.
- If a price is obviously incorrect (a manifest error) we reserve the right to cancel the Order, even after acceptance, and refund you in full.
5. Made-to-order & custom items
The majority of LoadBear products are precision-engineered and manufactured to your specification, including dimensions, finishes and configuration options entered at checkout.
You are responsible for ensuring all measurements, finishes and options are correct before submitting your Order. Once an Order has been accepted, made-to-order items cannot be cancelled, returned or refunded except where the Goods are faulty or not as described (see clauses 8 and 9).
6. Delivery
We deliver to mainland UK addresses unless otherwise agreed in writing. Delivery times shown on the Site are estimates and not guaranteed. We are not liable for delays caused by couriers or events outside our reasonable control.
Risk in the Goods passes to you on delivery. You should inspect the Goods on arrival and notify us within 48 hours of any visible damage or shortage.
7. Cancellations and returns
Because our Goods are made to your specification, the right to cancel under the Consumer Contracts Regulations 2013 does not apply (regulation 28(1)(b)). Please see our Returns Policy for full details.
Nothing in this clause affects your statutory rights in relation to faulty or misdescribed Goods.
8. Warranty
We warrant that, when correctly installed and used as intended, our Goods will be free from material defects in workmanship and materials for a period of 5 years from the date of delivery (the “Warranty Period”).
The warranty does not cover: damage caused by misuse, neglect, accident, incorrect installation, modification, or normal wear and tear; cosmetic finishes affected by environmental conditions; or any third-party components attached to the Goods.
To make a warranty claim, contact sales@load-bear.co.uk with your order number, photographs and a description of the issue. Our liability under this warranty is limited, at our option, to repair, replacement, or refund of the affected Goods.
9. Your statutory consumer rights
If you are a consumer, you have legal rights in relation to Goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect those statutory rights.
10. Limitation of liability
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) breach of the implied terms as to title; or (d) any other liability that cannot be limited or excluded by law.
Subject to the above, our total liability to you for any loss arising out of or in connection with a Contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will be limited to the price paid for the Goods to which the claim relates.
We will not be liable for any loss of profits, loss of business, loss of contracts, loss of anticipated savings, or any indirect or consequential loss.
11. Intellectual property
All content on the Site — including designs, drawings, photographs, text, logos and software — is owned by or licensed to Wheeler Fabrications Ltd and is protected by UK and international intellectual property laws. You may not reproduce, modify, distribute or commercially exploit any content without our prior written consent.
12. Events outside our control
We will not be liable for any failure or delay in performing our obligations under a Contract that is caused by events outside our reasonable control, including (without limitation) acts of God, war, terrorism, civil unrest, strikes, fire, flood, epidemic, supply chain failure, or government action. Where such an event occurs, we will notify you and either party may cancel the Contract, in which case we will refund any payment taken for undelivered Goods.
13. Privacy and cookies
We process your personal data in accordance with our Privacy Policy and use cookies as described in our Cookie Policy.
14. Changes to these Terms
We may update these Terms from time to time. The version that applies to your Order is the version published on the Site at the time the Order is placed. Material changes will be highlighted on the Site.
15. Governing law and jurisdiction
These Terms and any Contract are governed by the laws of England and Wales. Any dispute arising under or in connection with them is subject to the non-exclusive jurisdiction of the courts of England and Wales.
